Privacy Policy

Last updated:

Nightsesh is now StudyGPA. Same app, same company (Sparks Strategies LLC). This page still uses the old name in places while we update it; everything on it applies to StudyGPA.

Nightsesh ("Nightsesh", "we", "us") is an AI study platform for iPhone, iPad and Mac, made by Sparks Strategies LLC. You can study with Nightsesh's AI tutor by typing or talking, by listening (Walk & study), and by recording your classes and turning them into notes. This policy explains what information Nightsesh collects, why, who helps us process it, how long we keep it, and the choices you have. We wrote it in plain English. If anything is unclear, email us at support@nightsesh.com.

The short version

1. Who this policy covers

This policy covers the Nightsesh apps (including test versions in Apple's TestFlight), the Nightsesh service behind them, and these web pages. It doesn't cover Apple's App Store, Sign in with Apple, Siri, or other companies' apps and websites. Their own privacy policies apply.

2. Age requirement

You must be at least 13 to use Nightsesh. Before you sign in, Nightsesh asks you to confirm you're at least 13, and we record the time you did. We don't ask for your birth date. Nightsesh isn't directed to children under 13, and we don't knowingly collect personal information from them. If we learn that someone under 13 has an account, we'll delete it and its data. If you're a parent and think your child under 13 is using Nightsesh, email us and we'll delete the account.

If you're 13 to 17, please use Nightsesh with your parent or guardian's knowledge. Purchases go through Apple, where a parent can approve them with Ask to Buy.

3. What we collect

Information you give us

InformationDetails
AccountYour Sign in with Apple account ID, and your email address if you choose to share it (Apple may give us a private relay address instead). The time you confirmed you're 13 or older. Whether AI study help is on, when you turned it on, and which version of our AI notice you agreed to (so we can ask again if our AI providers change).
Study material in your TopicsNotes you type or paste, study guides, and document files (such as PDF, Word, PowerPoint, Excel and EPUB). We keep original document files so you can open them again. Photos of notes, scans and handwriting are read on your device, then uploaded privately with your material (the picture too), so Nightsesh can read their diagrams and drawings. When it makes study material, Nightsesh may keep a figure from your own material (a diagram on a page or slide, a drawing, a photo), cropped and labeled in that Topic, to show on your study cards. Only you can see them, and they're deleted with the material or the Topic. For recordings, only the transcript is uploaded, not the audio. Material is uploaded only after you turn on AI study help.
What Nightsesh makes from itOutlines, study cards, explanations and citations (such as "Slide 12"). Cards you write yourself.
Conversations with the AI tutorWhat you ask, typed or said out loud, and the AI tutor's replies. Spoken turns are saved as words (a transcript), never as audio. Conversations aren't tied to a Topic. They stay in the AI tutor's History until you delete them. When you ask something, the AI tutor can search all of your own material in every Topic (notes, cards, sources, Jots and photos you added) for the parts that help, and it names the Topic they came from (for example, "your Periodic table notes"). It never searches anyone else's material. Web search: when a question needs current facts (news, prices, the latest results), the AI tutor can search the web. Your question and the recent conversation go to Anthropic, which runs the search; the searches use words from your question, never your name or account. The pages it used are listed under the reply. If you attach or show a photo (for example, of your work), it's sent to our AI provider to answer you. We keep only a fingerprint (a hash) of the photo, not the photo itself. The AI tutor also keeps a few short "reminders" about how you study (for example, "found photosynthesis tricky") that expire on their own (see section 8).
Class notesIf you're signed in, your notes sync privately to your study account: titles, sections, earlier versions, Jots, editable handwritten and drawn pages, photos and imported page files, marks ("This matters", "Lost me"), the class transcript, and text read from photos and slides. These files are kept with the note, its original and earlier versions. Older photos can join sync from the device that still has them. Class audio stays on the device that recorded it. Private sync itself does not send notes or photos to AI; AI features use the material they need when AI study help is on.
AI requests about your notesWhen you use Make my notes, ask the AI tutor to change a note, Quiz me, ask a question across your notes, or search your notes by meaning, the content that request needs is sent to our AI provider. We keep a record of each request with its result and a fingerprint of what was sent. That way a dropped connection doesn't lose your notes and you're never charged twice.
Walk & studyTo make a walk, we send the ideas you're studying and how well you know them, some of your cards, and short excerpts from your material. We keep the finished script. The spoken audio is made from the script and downloaded to your device so it plays without a signal.
Voice timeSee "Live voice" below. We store how many voice seconds you used and when.
Study progressYour answers, whether they were right, timing, mastery, exam dates and goals.
Test dates and deadlines (Coming up)The tests, quizzes and assignments you save: the title, what kind it is (test, quiz, assignment or other), the date (and time, if you give one), its class if it has one, and where it came from. They're saved when you add one; when the AI tutor saves one you mentioned (it shows Added · Undo, so you can take it back); when a class note mentions a date and you tap to add it; or from your calendar (see "Your calendar" below). They're kept in your study account so Coming up matches on all your devices. The AI tutor sees your upcoming ones (the next three weeks) so it can plan your studying, and that list goes to our AI providers with your questions (section 6).
Questions made from your conversationsAfter a conversation with the AI tutor goes quiet, the AI tutor may write up to two check questions from it for your Study feed, each filed to one of your Topics. Writing and checking them uses AI help from Anthropic (section 6). We keep the questions and your answers.
Friend invitesIf we offer friend invites and you use one, we record your invite code, who invited whom, and a random install ID (so a code can be claimed only once per device).
Feedback and reportsWhat you send through "Report a problem", "Share an idea", or Report on a card or reply, and what it's about. Unless you switch it off in the report, we also get the app version, device type (such as "iPhone"), system version, the screen you were on, your language setting and recent error messages. Error reports, only if you turn them on (you're asked once, and it's a switch in Settings): when something goes wrong, the app sends the error message (with your titles and file names taken out), the screen and the same app and device details by itself. Never your notes, cards, recordings, photos or conversations.
PurchasesFrom Apple's signed purchase records: which plan (monthly or yearly), purchase and expiry dates, free-trial status, refunds, and Apple's transaction IDs. We never see your card or payment details.
Support emailsWhat you write to us and your email address.
Beta sign-up and emailsIf you join the beta at beta.nightsesh.com, you give us your first name, your email address, where you are in school, and that you're 13 or older, and we record when you signed up. Joining the beta includes our emails: occasional beta updates (new builds, what to try, changes to the beta) and Nightsesh news (launch day and big new features). Every email has an unsubscribe link, or email us. Unsubscribing never costs you your beta spot or allowance.

Live voice

Talking with the AI tutor is a live conversation. While voice is on (you'll see the live strip at the bottom of the screen), here's what happens:

Language lessons

In a language course, the words and example sentences you're learning are read aloud by OpenAI once, and we keep those audio clips with your course so lessons play instantly and offline. If you answer a lesson question out loud, that short recording goes through our server to OpenAI to be written down, so Nightsesh can check your answer. We don't store your spoken answers; we keep only whether the answer was right. You can study with no microphone at all (Quiet or Listen).

Your calendar (only if you turn it on)

Calendar is off until you turn on Settings › AI tutor › Use my calendar and allow Nightsesh to see your calendars. It works with any calendar on your device, including Google, Outlook or school calendars you've added to it.

Information collected automatically

InformationDetails
Usage and limitsHow much AI help and voice time you use, to apply plan limits and prevent abuse.
Usage countsOn unless you turn them off, including in TestFlight betas. Simple first-party events: install, first material added, first cards, first reply, plan screen seen or closed, voice taste used, trial started, paid, a once-a-day "active" mark, review prompt requested (Apple decides whether it shows), and which features you use: the feature's name (for example, that the AI tutor was opened from a card), counted at most once a day each. Each comes with a random install ID the app makes, your platform (iOS, iPadOS or macOS) and the time, and is kept with your account. They never contain what you study, write or say, go only to our own server, and are never shared. Turn them off any time: Settings › Help make Nightsesh better › Share usage counts.
Apple Ads attributionIf usage counts are on and you installed Nightsesh from an Apple Ads ad, Apple can tell us which of our campaigns it was. The app gets a one-time token from Apple, and our server exchanges it with Apple. We keep only whether an ad was involved, the campaign, ad group and keyword IDs, and the country or region. This doesn't use your advertising identifier and doesn't identify your device.
Technical dataLike any online service, our servers receive your IP address and basic request details. Our own servers log only warnings and errors, never your sign-in token. Our hosting and database providers keep technical logs, which can include IP addresses, for a short time (currently 7 days or less). Our sign-in provider records sign-in events for security.
TestFlightIf you test a beta through Apple's TestFlight, Apple gives us the name and email you were invited with, and any crash reports, feedback and screenshots you choose to send. Apple's TestFlight terms apply.

We don't collect your location, contacts, advertising identifier (IDFA), browsing history, health data, or voiceprints or other biometric identifiers. Nightsesh doesn't read other apps or your screen outside Nightsesh. The one exception is your calendar, and only if you turn it on (see "Your calendar" above).

4. What stays on your device

Your saved notes stay on your device until you delete them or delete the app. Unused note files follow the cleanup period in section 8. They may be included in your device or iCloud backups, which Apple's policies cover.

5. How we use information

We don't look through your study material, notes or conversations. We see them only when you send them to us in a report or support request, when we need to fix a problem you've asked us to fix, to investigate abuse or a safety concern, or when the law requires it.

We don't use your information for ads. We don't sell it or "share" it (as California law defines "share"). We don't use it for profiling that has legal or similarly significant effects on you. We don't train AI models on it, and our AI providers don't either (section 6).

6. Who helps us (service providers)

We use a small number of companies to run Nightsesh. They may use your information only to provide their service to us. Each of them, other than Apple (whose own Privacy Policy covers what it collects), is bound to protect your information at least as well as this policy does and as Apple's App Review Guidelines require.

CompanyWhat they doWhat they receive
Anthropic (Claude)AI for the AI tutor's typed replies (including photos you attach); the harder questions, photos and answer checks you ask during live voice; turning your material into outlines and cards; reading the diagrams and pictures in your material; drawing pictures for cards; checking photos of your work; making and changing notes; Quiz me; searching your material by meaning; writing Walk & study scripts; checking language answers; planning your studying around your upcoming tests; finding dates a class note mentions; writing check questions from your conversations for your Study feed; and searching the web when a question needs current facts (Anthropic runs the search)The material each request needs (including passages from any of your Topics that help answer you), the words of your question and the recent conversation (typed or transcribed from voice), your upcoming tests and deadlines (the next three weeks) and your Topic and Folder names, plus our safety instructions. Anthropic doesn't train its models on this data. It deletes API inputs and outputs within 30 days. If its automated safety systems flag a request as breaking its Usage Policy, it may keep that request for up to 2 years (Anthropic).
OpenAILive voice (listening, turning speech into text, and speaking); reading Walk & study scripts and language words aloud; writing down spoken answers in language lessonsDuring live voice: your microphone audio, what's on your Nightsesh screen, your upcoming tests and deadlines (the next three weeks), your Topic and Folder names and recent note titles, passages from your material the AI tutor looks up, the AI tutor's answers, and any photo you choose to show it. For walks: the script text. For language lessons: the words and sentences to read aloud, and the short recording of an answer you say out loud. OpenAI doesn't train on API data by default, and it keeps abuse-monitoring logs for up to 30 days (OpenAI).

Before any of your material goes to an AI provider for the first time, Nightsesh asks you. If we add an AI provider or change what we send them, Nightsesh asks you again before using it. You can turn AI study help off at any time in Settings › AI & privacy. Turning it off stops new AI requests and ends live voice. It can't recall material that was already processed. You can still study the cards and notes you already have.

We may also disclose information:

7. Sharing with other students

Nightsesh doesn't let you share your Topics, cards, notes or conversations with other students. Your material stays private to you. That's what lets Nightsesh use your own photos, slides and handouts on your cards. If this ever changed, we'd update this policy first, and nothing would be shared unless you chose to share it.

8. How long we keep information

9. Your choices and rights

We'll take reasonable steps to confirm that a request really comes from you, or from someone you've authorized. For example, we may ask you to write from the email address on your account or to confirm something only you would know. We use what you give us for this only to handle the request.

U.S. state privacy rights

Depending on where you live (for example California, Colorado, Connecticut, Delaware, Maryland, Oregon, Texas or Virginia), you may have the right to:

To use these rights, email support@nightsesh.com. You can also have an authorized agent send a request for you. We may ask the agent for proof that you gave permission, and we may ask you to confirm your identity with us directly.

Appeals. If we turn down your request, in whole or in part, we'll explain why. You can appeal by replying to our answer or by emailing us with "Appeal" in the subject line. We'll answer your appeal in writing within 45 days and explain what we decided and why. If you disagree with the result of your appeal, you can contact your state's attorney general. For example, Colorado residents can go to coag.gov, Connecticut residents to portal.ct.gov/ag, and Virginia residents to oag.state.va.us.

Teens

We don't sell teens' information, don't show them targeted ads, and don't profile them for decisions with legal or similarly significant effects. This goes for every user, whatever their age.

Global Privacy Control and "Do Not Track"

We don't sell or share personal information and don't track you across other sites or apps, so there's nothing to opt out of. If your browser or device sends a Global Privacy Control signal, we'll treat it as a request to opt out of sale and sharing, just in case.

13. Where we operate

Nightsesh is offered in the United States. We and our database and hosting providers store and process information in the United States. If you use Nightsesh from somewhere else, your information will be transferred to the United States.

14. Changes to this policy

If we change this policy, we'll update the date at the top. If a change is important, we'll tell you in the app before it takes effect. If we ever want to use your information in a way this policy doesn't allow, we'll ask you first.
